INTRODUCTION AND ACCEPTANCE

These Terms of Service (“Terms”) are an agreement between you and [Legal Business Name], operating as Gym Date (“Gym Date,” “we,” “us,” or “our”). They govern the Gym Date mobile app, https://getgymdate.com, and related dating, discovery, matching, messaging, premium and support features (the “Services”). By creating an account or using the Services you agree to these Terms. If you do not agree, do not use the Services. Review our Privacy Policy at https://getgymdate.com/privacy-policy/. Where required, we request separate consent for particular processing.

ELIGIBILITY

Gym Date is exclusively for people 21 or older who have legal capacity to agree and may lawfully use a dating service in their jurisdiction. You must provide accurate information, not impersonate others, and comply with law. You may not use Gym Date if suspended or prohibited from doing so. We may review eligibility where appropriate, but do not independently verify every member’s identity or age and do not guarantee other users’ profile information.

REGISTRATION AND ACCOUNT SECURITY

Create an account using your own valid email address and password; keep credentials confidential and account information current. Each account is for one person; selling, transferring, lending, impersonating, or using multiple accounts to evade restrictions is prohibited. Report suspected unauthorized access promptly to [Support Email Address].

DESCRIPTION OF THE SERVICE

Gym Date helps fitness-minded adults discover dating profiles, express likes, match where interest is mutual, and message eligible matches. We offer distance/preferences filtering and an informational fitness-compatibility score; certain filters and visibility features require premium access. We do not guarantee matches, responses, dates, successful relationships, identity verification, or personal safety. Gym Date is not a medical, fitness-coaching, background-screening, or individually verified matchmaking service.

PROFILES AND PHOTOGRAPHS

Keep your age, identity, photos, location, family and relationship information, fitness interests and other statements truthful. Do not use deceptive photos or impersonate another person. Only upload materials you have the rights and permissions to share. We may remove prohibited or misleading profiles, images, or content.

COMMUNITY STANDARDS

Treat others respectfully. The following are prohibited:

Harassment, bullying, intimidation, stalking, threats, violence, or attempts to bypass blocks.
Hate-based abuse, unlawful discrimination, sexual exploitation, nonconsensual intimate images, or unsolicited explicit material.
Fraud, romance scams, phishing, impersonation, deceptive investment pitches, or requests for money under false pretenses.
Spam, mass messaging, unsolicited advertising, commercial recruitment, or using the dating service to promote unrelated products.
Scraping, bots, account intrusion, malware, exploiting vulnerabilities, and bypassing security or purchase restrictions.
Any unlawful use of the Services or violation of another person’s privacy or intellectual property rights.

Gym Date may use technical controls, member reporting, and authorized review to identify objectionable content and enforce these rules. We do not guarantee every photo or message is reviewed before it appears or that all inappropriate material will be detected.

MATCHING AND MESSAGING

Likes and mutual matches depend on profile eligibility, preferences, previous interactions, and safety restrictions. Users may receive no matches or responses. Messaging is available only through eligible matched conversations, and you must communicate respectfully. Conversations may close due to unmatch, block, account deletion, suspension, termination, or security controls. We do not guarantee uninterrupted access to messages or continued availability of a match.

UNMATCHING

An unmatch ends the existing connection, deactivates the match, and makes the conversation unavailable to participants; no further messages may be sent through it. Unmatching is distinct from permanent blocking. It does not necessarily prevent the former match from reappearing in discovery. Conversation records may remain under the Privacy Policy.

PERMANENT BLOCKING

Blocking ends the connection and existing message access and prevents both accounts from discovering, matching with, or messaging one another through Gym Date. Blocking is permanent from the member’s perspective; Gym Date offers no unblock option. A warning is shown before confirmation. Blocking does not stop off-platform contact or automatically resolve safety concerns outside the Services. Relevant enforcement records may remain.

REPORTING, REVIEW AND ENFORCEMENT

Members can use the in-app Report User feature to report harassment or bullying, inappropriate behavior or content, fake profiles, impersonation, spam, scams, safety concerns, or other misconduct. Reports may include details and an optional image. If unable to report in-app, contact [Support Email Address]. Submit reports in good faith; knowingly false reports are prohibited.

Gym Date may review relevant accounts, photos, messages, prior safety records, and submitted evidence; request further information; remove content; restrict features; suspend or terminate accounts; or cooperate with authorities when appropriate. Reporting does not automatically block or unmatch another person, and does not guarantee an enforcement outcome. We aim to address credible reports promptly but do not guarantee a fixed response time. Access to confidential report materials is restricted to authorized personnel, though absolute confidentiality cannot be promised where law requires disclosure.

The report feature is not an emergency service. For immediate danger or suspected crime requiring urgent assistance, contact emergency services or law enforcement.

DATING SAFETY AND IN-PERSON MEETINGS

GYM DATE DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON MEMBERS BEFORE PERMITTING THEM TO COMMUNICATE WITH OTHER MEMBERS. Do not assume a profile has passed criminal-history, sex-offender, identity, or safety screening. Display this notice conspicuously and in the format Texas law requires wherever applicable.

DATING SAFETY AWARENESS NOTICE. Be alert to people using false identities or deceptive profiles. Protect your identifying information and financial details. Never send money, gift cards, or cryptocurrency to someone merely because you met them online. Be cautious about revealing home address, gym, daily workout schedule, or precise whereabouts. When meeting someone, choose a public place, arrange your own transportation, tell someone you trust, and leave if you feel unsafe. A match or date never creates an obligation to engage in romantic, sexual, physical, or fitness activity. Respect consent and boundaries.

Members arrange and undertake their own off-platform encounters, workouts, and exercise. Gym Date does not supervise private meetings, assess exercise safety, or provide emergency or medical services. Report misconduct through the app; contact authorities in emergencies.

PREMIUM SUBSCRIPTIONS

Gym Date may offer free features and optional monthly or annual premium subscriptions. Features can include Likes You visibility and advanced discovery preferences. Current price, billing period, benefits, any trial or introductory terms, and renewal charges are shown in the applicable purchase flow; displayed transaction terms govern subject to law. Premium does not guarantee matches, responses, or relationships.

Subscriptions automatically renew unless canceled under Apple App Store or Google Play rules. Subscription purchases and renewals are handled by Apple/Google, and RevenueCat validates entitlements. Cancel through the platform subscription settings, preferably before the relevant renewal deadline. Cancellation generally prevents later renewals while paid access may continue until the current period ends, subject to platform terms. Deleting your Gym Date account does not cancel an active subscription.

Eligible purchases may be restorable using available in-app restoration features and platform verification. For restoration issues email [Support Email Address]. Refunds, trials, taxes, changes, and introductory pricing are subject to the applicable purchase disclosures, platform rules, consumer law, and any legally required notice/consent. We do not promise a refund that the governing platform or law does not provide.

USER-GENERATED CONTENT

You retain ownership of your original profile text, photos, messages, and reports where you own the rights. You grant Gym Date a limited, nonexclusive, worldwide, royalty-free license to host, store, display, transmit, process, and review content only as needed to provide the Service, enforce these Terms, respond to safety issues, and comply with law. The license ends when content is deleted except to the extent continued retention or processing is legally permissible. You are responsible for rights and legality of your submissions. We may remove prohibited content and preserve relevant evidence when justified.

INTELLECTUAL PROPERTY

Subject to third-party rights and user-generated content, Gym Date and its licensors retain rights in their software, design, logos, branding, graphics, and website materials. We grant a limited, personal, nonexclusive, nontransferable, revocable license for lawful personal dating use. Do not commercially copy, redistribute, or misuse protected content without permission, except where law permits. Mentioning the Gym Date brand does not claim that a federal trademark registration has issued.

PRIVACY

Our Privacy Policy at https://getgymdate.com/privacy-policy/ explains collection, profile visibility, approximate distance/location, messages, purchases, push notifications, reports, data retention, rights requests, and account deletion. Review it before using Gym Date. Consent will be requested separately where required.

ACCOUNT DELETION AND CHAT RETENTION

Delete an account using Settings → Account & Privacy → Delete Account, followed by confirmation. Once successful, deletion is irreversible and removes the Firebase Authentication account, primary Firestore profile, user-specific uploaded files, incoming/outgoing swipes, associated matches, and the internal premium entitlement. Some operational and safety records remain.

Deleting an account does not immediately delete chat documents or messages. Associated chats are closed, hidden from participants’ Recent Chats, inaccessible through member-facing interfaces, and blocked from further messaging. The remaining participant receives the existing conversation-closure notice. Authorized administrative access may be used for safety, security, or legal purposes.

Gym Date has an intended 90-day ordinary chat retention period starting when the first participant permanently deletes an account. Automatic 90-day deletion has not yet been implemented, so stored conversations may currently persist longer. Continued retention for a specific investigation or legal requirement may be permitted; users retain applicable privacy rights. See Privacy Policy Sections 10 and 11. Account deletion does not cancel Apple/Google subscriptions; cancel separately.

SUSPENSION AND TERMINATION

We may restrict, suspend, or terminate accounts or remove content for violations, credible safety concerns, fraud, security, or legal compliance. Immediate action may occur without prior notice when appropriate. Termination can remove discovery, matching, messaging, and paid access, but a platform subscription may require separate cancellation. Data retention and deletion remain governed by law and the Privacy Policy; consumer rights that cannot be waived remain intact.

THIRD-PARTY SERVICES

Google Firebase/Cloud, RevenueCat, Apple, and Google Play support authentication, hosting, storage, push delivery, subscription processing, and distribution. Their independent terms and privacy notices may apply. We are not responsible for independent third-party services to the extent permitted by law.

SERVICE AVAILABILITY

We seek to provide a reliable app but cannot promise uninterrupted, error-free service. Maintenance, infrastructure outages, updates, security issues, network problems, or external providers may affect availability. We may change or discontinue features, subject to applicable purchase, notice, and consumer-protection obligations.

DISCLAIMERS

TO THE EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” We do not guarantee member identity, honesty, background, intent, safety, matches, dates, successful relationships, continuous service, or that all misconduct is detected. Gym Date does not supervise independent offline interactions. This section does not exclude warranties or rights that cannot lawfully be excluded.

LIMITATIONS OF LIABILITY

To the maximum extent permitted by applicable law, Gym Date and its authorized representatives are not responsible for indirect, incidental, special, consequential, or punitive damages associated with use of the Services, other members’ independent actions, service interruption, or lost data. This does not exclude liability that cannot legally be limited, including applicable fraud, willful misconduct, or other nonwaivable liability. No specific monetary liability cap is established in this draft; any such term requires individualized legal review.

MEMBER DISPUTES

Members are responsible for their own relationships, agreements, and off-platform encounters, subject to applicable law. Gym Date is not automatically a party to disputes merely because people connected on the app. Report violations through the app and seek appropriate legal or emergency assistance when warranted. Nothing in these Terms prevents legally available remedies.

GOVERNING LAW AND LEGAL DISPUTES

Subject to mandatory consumer protections, these Terms are intended to be governed by Texas law without regard to conflicting choice-of-law rules. For informal resolution contact [Legal Contact Email Address]. These Terms do not currently require arbitration, waive class-action rights, or mandate an exclusive venue. Any such provisions should be reviewed by qualified counsel before adoption.

MODIFICATIONS TO TERMS

We may revise these Terms for product, safety, subscription, legal, or operational changes. We will update the Last Updated date and provide notice or request agreement when required. Material changes will not retroactively extinguish nonwaivable rights. If you disagree, discontinue use and consider deleting your account.

SEVERABILITY

If a provision is invalid or unenforceable, the remainder remains effective as permitted by law; a challenged term will be limited only as necessary to satisfy law.

ENTIRE AGREEMENT

These Terms and applicable supplemental terms constitute the agreement governing the Services, except as otherwise required by law. They do not restrict statutory protections that cannot be waived.
